§ 15-21. Alcoholic beverages on the ocean beach.

  • (a)

    It shall be unlawful for any person to possess alcoholic beverages on the ocean beach or dune in containers greater than one (1) gallon (one hundred twenty-eight (128) fluid ounces), except as may be authorized and permitted as part of a special event approved under provision of Chapter 14 of this Code.

    (b)

    Any person who violates or fails to comply with any provisions of this section "Alcoholic beverages on the ocean beach" shall be subject to the following:

    (1)

    The issuance of Class III citation in accordance with the provisions of City Code Chapter 31; or,

    (2)

    Enforcement by other means including, but not limited to: a summons; a notice to appear in the county or circuit court; an arrest; an action before the special magistrate/code enforcement board; or a civil action for injunctive relief; or,

    (3)

    Punished in accordance with general penalty set forth in Chapter 1, section 1-8 of this Code.
