§ 26-10. Parking on public rights-of-way.

  • (a)

    Scope. The regulations herein this section shall apply to all house trailers, semitrailers, trailers, and commercial motor vehicles, as defined in Section 316.003, Florida Statutes.

    (b)

    Purpose and intent. The City of Cocoa Beach City Commission finds that the parking of certain vehicles defined above on public roads, streets or alleys could be hazardous to the citizens of Cocoa Beach by restricting visibility and impeding the free and safe flow of traffic thereon. Therefore, it is the purpose and intent of this ordinance to prohibit parking of certain vehicles during specific hours in the City of Cocoa Beach. Passenger cars and straight trucks that are not defined as commercial motor vehicles are specifically exempted from this section of the Code.

    (c)

    Regulations regarding parking of house trailers, semitrailers, trailers and commercial motor vehicles. Except as otherwise provided herein, no house trailers, semitrailers, trailers or commercial motor vehicles shall be parked or stored on any public rights-of-way, street or roadway in the City of Cocoa Beach at any time between the hours of 7:00 p.m. and 7:00 a.m. In special situations, the city manager may authorize the parking of such vehicles for a temporary period and set conditions as may be determined necessary to ensure compliance with the purpose of this regulation.

    (d)

    Nothing herein prohibits the parking of utility company, public or private road service vehicles for the period of time required in the locating, relocating, installation, servicing testing or repair of equipment, or in the construction, repair or maintenance of any road or street, in any zoning district.

    (e)

    Enforcement and removal of illegally parked vehicles. To enforce the provisions of this section, members of the police department are authorized to:

    (1)

    Issue a citation for "Other" violation, as set forth in section 26-29, City Code; and/or,

    (2)

    Remove a vehicle, parked in violation of this section, to a garage or other place of safety in accordance with procedures and authority specified in section 26-1 and section 26-2 of this Code.

Section 16 of Ord. No. 627, enacted July 2, 1980, repealed former § 26-10, which pertained to failure to appear in response to a notice to appear resulting from a traffic violation. Said provisions derived from § 7 of Ord. No. 384, enacted Jan. 20, 1972. Ord. No. 1263, § 1, adopted Jan. 18, 2001, enacted new provisions as § 26-10 to read as herein set out.
