§ 28-37. Exemptions.

  • The following activities shall not be considered an illicit discharge or illicit connection, unless such activities cause, or significantly contribute to, the impairment of the use of the city's MS4 or the violation of the conditions of the city's NPDES stormwater permit:

    (1)

    Water line flushing or other potable water sources;

    (2)

    Landscape irrigation or lawn watering;

    (3)

    Rising groundwater;

    (4)

    Ground water infiltration to stormdrains;

    (5)

    Uncontaminated pumped ground water;

    (6)

    Foundation or footing drains (not including active groundwater dewatering systems);

    (7)

    Crawl space pumps;

    (8)

    Air conditioning condensation;

    (9)

    Springs;

    (10)

    Non-commercial washing of vehicles;

    (11)

    Natural riparian habitat or wetland flows;

    (12)

    Swimming pools (if dechlorinated - typically less than one part per million chlorine);

    (13)

    Discharges or flow from emergency fire fighting activities and emergency response activities done in accordance with adopted spill response/action plan;

    (14)

    Discharges for which all appropriate federal, state and local permits have been obtained and which are in compliance with the conditions of said permits.
