§ 30-22. Citation authorization; violation as civil infraction; maximum civil penalty.

  • (a)

    Any code enforcement officer, designated pursuant to section 30-4 is hereby authorized to issue a citation for the violation of any city code or ordinance to a person when, based upon personal investigation, the code enforcement officer has reasonable cause to believe that the person has committed a civil infraction in violation of a duly enacted code or ordinance and that the county court will hear the charge.

    (b)

    A code or ordinance violation shall be deemed to be a civil infraction.

    (c)

    The maximum civil penalty for such a civil infraction shall not exceed five hundred dollars ($500.00) per violation plus all applicable costs of prosecution and legislative assessments plus court costs.

    (d)

    Each violation of a code or ordinance shall be a separate civil infraction. Each day such violation shall continue shall be deemed to constitute a separate civil infraction.
