§ 3-1. Hours of sale—In general.

  • It shall be unlawful for any person to sell, serve, consume or permit to be sold, served or consumed in any place within the city holding a license under the beverage laws of the State of Florida, any alcoholic beverage, between the hours of 2:00 a.m. and 7:00 a.m. on Mondays, Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays; between the hours of 2:00 a.m. and 12:00 noon on Sundays; and between the hours of 4:00 a.m. and 7:00 a.m. on January 1. Provided, however, it shall not be unlawful for any person to sell, serve, consume or permit to be sold, served or consumed in any place within the city holding a license under the beverage laws of the State of Florida, any beer, ale or wine between the hours of 7:00 a.m. and 12:00 noon on Sundays; and provided, however, that it shall not be unlawful for any person to sell, serve, consume or permit to be sold, served or consumed any alcoholic beverage between the hours of 7:00 a.m. and 12:00 noon on Sundays if such selling, serving or consuming or permitting of same is for on-premises consumption only.

    Annotation— In exercise of its police power, municipality may regulate and restrict liquor vendors in operation of their businesses, and has a wide discretion in classifying such vendors and may enact restrictions and regulations to that end so long as they are on a reasonable and practicable basis as to each classification sought to be regulated, Miami Beach v.
