Chapter 5. BEACHES, FILLS, BOATS AND WATERWAYS |
Article I. WATER SAFETY |
§ 5-1. Definitions.
[For the purpose of this chapter, certain words and terms are defined as follows:]
Cocoa Beach waterways shall include all navigable waters within the city limits.
Launching shall mean the actual physical act of removing the vessel from the trailer, dolly or other carrying device and placing the vessel in the water.
Motorboat includes any vessel or personal watercraft propelled in any respect by machinery.
Person shall include any individual, firm, partnership, corporation, company, association, joint stock association, or body politic, except the United States, and the State of Florida, and includes any agent, trustee, executor, receiver, assignee, or other similar representative thereof.
Slow speed/minimum wake means the speed of a motorboat shall be such that the motorboat is completely off plane and fully settled into the water. Motorboats may then proceed at a speed which is reasonable and prudent under the existing conditions. Large displacement hull motorboats shall not create a large, damaging or potentially dangerous wake, even though settled in water they must compensate by reducing speed.
Surfboarding means to ride the crest of a wave or other surface of the water by means of a long narrow board or some similar device or contrivance. This includes windsurfers.
Vessel is synonymous with boat as referenced in section 1(b), Article VII, of the State Constitution and includes every description of watercraft, barge, and air boat, other than a seaplane on the water, used or capable of being used as a means of transportation on water. This includes all types of personal watercraft.
Water-skiing means to be towed on a ski-like board or device by the use of a line attached to a vessel. This includes parasailing.
