§ 5-15. Stopping, parking, mooring and towing.

  • (a)

    It shall be a violation of this article for any person to leave any vehicle or trailer, apparatus or device used for towing or carrying a vessel, on the shore of the city in such a position as to obstruct the free and peaceful use of the surrounding shoreline or water's edge. No person shall leave such trailer, apparatus or device in such a position where it would be an obstruction or hazard to the flow of traffic or so as to prevent reasonable access to the shore or water's edge.

    (b)

    The operator of any vessel shall not moor, anchor, tie-up, or otherwise secure a vessel to any public sign, marker or buoy upon or beside the waters of the city.

    (c)

    A moored vessel, or combination of moored vessel and pier, slip, dock, boathouse or boat shelter, shall not project into any waterway more than forty (40) feet or twenty (20) per cent of the width of the waterway, whichever is less. The width of any waterway shall be measured from the upland (near) edge of the waterway at approximate mean water level (N.G.V.D. plus six tenths (0.6) feet), or from the bulkhead if such exists, across the waterway to the nearest of the opposite bulkhead, or if none exists, to the line of channel markers delineating the far side of the waterway or if not so marked, then to the point of minimum three (3) feet depth (at approximate mean water level) on the far side of the waterway. Nothing contained herein shall allow any projection of any vessel, dock or appurtenances, or combination thereof, that reduces the navigable width of the waterway (specifically those portions with depths of three (3) feet or more at approximate mean water level) to less than thirty-five (35) feet. No vessel shall be moored in such a manner as to infringe on equal right of access by adjoining property to the waterway.

    (d)

    Except under emergency conditions, it shall be a violation of this article for any person to moor, anchor, tie-up or otherwise secure a vessel in any waterway which would thereby restrict or endanger passage of another vessel.
