§ 5-29. Water-skiing or similar activity.

  • (a)

    No person under the age of sixteen (16) years shall operate a vessel upon Cocoa Beach waterways, having in tow, or otherwise assisting a person or persons on water-skis, surfboard, or such similar device unless there is in such vessel another person sixteen (16) years of age or older, in addition to the operator, in a position to observe the progress of the person or persons being towed or assisted. Any person sixteen (16) years of age or older shall be required to have another person in addition to the operator, in a position to observe the progress of the person or persons being towed or assisted or one (1) adequate wide-angled rear view mirror, properly situated, to conform to the Florida Statutes.

    (b)

    No person shall engage in water-skiing, aquaplaning, surfboarding, use of personal watercraft or such similar activity between the hours of one-half (½) hours after sunset to one-half (½) hour before sunrise.

    (c)

    Water-skiing, aquaplaning and high-speed planing on personal watercraft, are prohibited in Cocoa Beach canals and channels bordered by residences, or where vessels are anchored, and other posted restricted areas.

    (d)

    It shall be a violation of this article for any person or persons to manipulate any water-skis, surfboard or such similar device, so as to indicate a reckless disregard for the safety of other persons or property, or without due regard for the safety of other persons or property, or in such manner so as to endanger, or likely to endanger the person or property of others.
