§ 5-47. Compliance with building restriction line.

  • (a)

    Except as set forth in section 5-48, below, no building or portion thereof shall be constructed on the property lying adjacent to the Atlantic Ocean nearer said Atlantic Ocean than set forth by said building restriction line, identified as in section 5-45 above, and as marked on the official maps as the "Building Restriction Line." In determining the setback location of the building or structure, the line of the building shall be the eastern most projection of any porch or balcony, or if no porch, the front foundation of the building, excepting eaves not exceeding four (4) feet from the building wall, nearest the Atlantic Ocean Beach. The location of such structures with respect to the property side lines and any street shall be governed by such other zoning requirements as may otherwise exist.

    (b)

    In the event any structures are constructed east of the platted side lot lines the said lot lines including any property lines abutting any street or right-of-way are to be projected eastward to determine applicable setbacks.

    "Section 1. Supplement to official map.

    The official map as adopted in Section 1 of Ordinance 382 of the City of Cocoa Beach is supplemented by adding thereto a `Sea Wall Line' and `Building Restriction Line' from the center line of Orange Avenue (State Road 520) south to the city limits. A description of said lines having been prepared by the city engineers by description dated the 3rd day of February, 1972, which description is attached hereto as Exhibit `A'."
