§ 4-39. Application for a variance from the board of adjustment.

Where because a property is of exceptional narrowness, shallowness, shape or it has topographical or other extraordinary site conditions which exist, and the strict application of these LDC regulations would result in a peculiar, exceptional or undue hardship, as opposed to a mere inconvenience upon the property owner. The administrator may authorize a ten (10) percent waiver, or the board of adjustment may authorize a variance beyond that ten (10) percent threshold, as further defined by this article, if such variance or waiver can be made without destroying the intent of these LDC regulations. Any variance or waiver thus authorized shall be done in writing as to the reasoning behind granting such variance or waiver from these LDC regulations.
