§ 14-8. Indemnification/insurance; liquor liability insurance.

  • (a)

    Prior to the issuance of a special event permit (Class A or B), or Class C event permit, the applicant(s) shall execute an indemnification form which provides that the applicant(s) agrees to hold harmless and indemnify the city, its officers, agents and employees against any loss, damage or expense (including all costs and reasonable attorney's fees) suffered by the city for:

    (1)

    Any breach of the approved agreement reached at the planning meeting, including any inaccuracy in or breach of any representation, warranty or covenant made by the applicant(s) to the city.

    (2)

    Any claims, suits, actions, damages or cause of actions for any personal injury, loss of life or damages to personal or real property sustained by reason of, result of, or by presence of the applicant on public property by applicant's agents, employees, invitee and/or any other persons.

    (b)

    Insurance coverage shall be on licensed insurance company letterhead, or its legal equivalent, and shall provide liability insurance protection for the city, not less than one million dollars ($1,000,000.00) per person for bodily injury, one million dollars ($1,000,000.00) per accident and one million dollars ($1,000,000.00) per occurrence, indemnifying the city as "additional insured".

    (c)

    If alcoholic beverages are to be dispensed, served, sold or distributed at an outdoor event, the applicant(s) shall in addition provide liquor liability insurance in the amount of five hundred thousand dollars ($500,000.00) and include the City of Cocoa Beach as an additional insured.

    (d)

    The applicant shall pay the premiums for the insurance and provide the completed indemnification form to the city prior to issuance of the special event permit or Class C event permit.

    (e)

    Nothing in this section shall be construed to effect in any way the city's rights, privileges and immunities as set forth in Florida Statutes, section 768.28.
