§ 29-5. Review of site plans; inspections.

  • (a)

    During the review of a site plan or any other plan for construction, the building official shall use the national wetlands inventory maps, the county soil survey, the city comprehensive plan, aerial photography, or other applicable data in order to determine the potential existence of wetlands on or adjacent to the site.

    (b)

    If a review of the above documents indicates that wetlands may exist on or adjacent to the site, an inspection will be performed by the building official or his duly authorized representative.

    (c)

    Based on the assessment of the above site visit, the building official may require the developer to have the site inspected by a representative from the St. Johns River Water Management District for a determination of jurisdictional limits of the site. This also may require the involvement of the Army Corps of Engineers, the department of environmental regulations, and the department of natural resources.

    (d)

    No building permit shall be issued by the city until the applicable environmental agency has either approved the site plan, or an exemption letter has been issued by the applicable environmental agency.

    (e)

    All proposed development adjacent to canals and the Banana River will automatically be reviewed under the above process as well as any parcel of land characterized by the tidal swamp (Ts) soil series.
