§ 30-16. Powers of the special magistrate or a code enforcement board in code violation hearings.

  • The special magistrate or a code enforcement board, has the power and authority to:

    (1)

    Adopt rules for the conduct of code enforcement hearings and hearings pursuant to city codes and standard building codes.

    (2)

    To use where appropriate section 30-14 - enforcement procedure; section 30-15 - conduct of hearing; section 30-16A - enforcement; section 30-17 - administrative fines, costs and liens; section 30-18 - rehearing and appeals; and section 30-19 - notices.

    (3)

    Subpoena alleged violators and witnesses to code violation hearings. Subpoenas may be served by the city police department or sheriff of the county.

    (4)

    Subpoena evidence to code violation hearings.

    (5)

    Hold hearings.

    (6)

    Take testimony under oath.

    (7)

    Issue orders having the force of law to command whatever action is necessary to bring a violation into compliance, including but not limited to the imposition of administrative fines, costs of prosecution, and other noncriminal penalties.

    (8)

    Establish, levy, waive, reduce or alter fines pursuant to section 30-16A.
