§ 5-39. Commence work order, restrictions on and provision for issuance, payment of fees.

  • The building inspector shall issue a commence work order to the permittee upon being notified in writing by the city clerk that the permit has been issued, which notification shall be promptly given by the city clerk, and upon payment of the fee required under this section; however, no commence work order shall be issued, nor shall any work be done under any permit, until approval and permission as required by law shall have been obtained from Brevard County, the Trustees of the Internal Improvement Fund of the State of Florida, and the Corps of Engineers of the United States Army, and, when title to submerged lands is being obtained, until a conveyance or contract for land purchase or similar instrument entitling the permittee to work in or on any submerged area has been obtained from the Trustees of the Internal Improvement Fund of the State of Florida and recorded in the public records of Brevard County, Florida. The permittee shall pay to the city treasurer prior to the time of commence work order is issued hereunder a fee of two per cent (2%) of the estimated cost of construction of the work being done under the dredge and fill permit. This fee is for the purposes of administration and shall be allowed as a credit under the provisions of section 23-18(A)(3) of this code if applicable.
