§ 5-56. Fishing in man-made salt water residential canals.

  • (a)

    Restricted areas. It shall be unlawful for any person to catch or take fish from the following salt water residential canals by means other than hook and line or cast net thrown by hand:

    (1)

    The canal lying between Willow Green Drive and Country Club Road bounded on the west by the exterior bulkhead line.

    (2)

    The canal located between Danube River Drive and Crystal River Drive.

    (3)

    Those canals bounded on the south by 4th Street South, bounded on the west by the interior bulkhead line, bounded on the north by Minutemen Causeway, and bounded by Brevard Avenue on the east.

    (4)

    Those canals lying within an area bounded on the south by Minutemen Causeway; bounded on the west by Crystal River Drive, and all other canals lying easterly of the interior bulkhead line; and bounded on the north by Andros Avenue and St. Croix Avenue.

    (5)

    Those canals lying within an area bounded on the south by State Road 520 and lying easterly of the interior bulkhead line, to the north city limits.

    (6)

    The dredged major canal between the city's interior and exterior bulkhead lines, extending from the north end of Crystal River Drive northward to the west end of Andros Avenue.

    (7)

    The dredged major canal between the city's interior and exterior bulkhead lines, extending from the northwest corner of Yawl Drive residential land southward to the south city limits.

    (8)

    The dredged canal extending along the west side of Danube River Drive residential land from Minutemen Causeway north, thence eastward to the exterior bulkhead line at the northern terminus of Crystal River Drive lands.

    (9)

    The dredged canal extending along the north side of Andros Avenue and St. Croix Avenue residential land, from the interior bulkhead line eastward to So. Banana River Boulevard.

    (10)

    The dredged canal extending along the west side of residential lands bordering the bulkhead line from Florida Highway 520 northward to the northern city limits.

    (11)

    The dredged canal extending along the west side of residential lands bordering the bulkhead line from Florida Highway 520 southward to the south boundary of the Four Seasons Condominium property line.

    (12)

    The dredged canal beginning at the northwest corner of Yawl Drive residential land eastward and the dredged canal on the west side of La Riviere Road northward to Minutemen Causeway.

    (13)

    The dredged canal beginning at the northwest corner of the Cocoa Beach Municipal Golf Course extending north, then east along the entire residential area to Minutemen Causeway opposite Cocoa Beach High School.

    (b)

    Definition. As used herein, the term "canal" shall be as defined in Appendix A to this Code of Ordinances of the City of Cocoa Beach, commonly known as the zoning ordinance. The boundaries set forth herein shall be as shown on the official hunting, surfing and waterways map for the City of Cocoa Beach.

    (c)

    Penalties for violation. Any person convicted of a violation of this section shall be punished by a fine not exceeding five hundred dollars ($500.00), or by imprisonment for a term not exceeding sixty (60) days, or by both fine and imprisonment.
