§ 6-21. Excavation permit required.

  • No excavation shall be made on or into any land in the city or on any land in any area adjacent to the city which may be subject to subdivision or similar land development control or building regulations of the city nor shall any extraction from said land of materials, such as dirt, sand, gravel, rock, clay, marl, minerals or soil be permitted unless and until an excavation permit shall first have been obtained from the city; provided, however, this requirement shall not apply to the following excavations or extractions of material:

    (1)

    Excavations for the foundation or basement of any building or for a swimming pool for which a building permit has been issued, or deposits on the earth of any building of construction materials to be used in a structure for which such building permit has been issued.

    (2)

    Grading of any parcel of land for a permitted use where no bank of more than five (5) feet in vertical height is constructed or when less than five hundred (500) cubic yards of earth are removed from the premises.

    (3)

    Any undertaking for which a dredge and fill permit is required pertaining to the affected land and has been obtained according to law.
